@hugly -- Didn't read it in the proposed legislation, but relied on jwrl's citation of Bart Veldhuizen of BlenderNation's concerns [in the first post on this thread], and jwrl's own repetition of possible problems for LW's Forum.

I find this persuasive, in that the the Forum could be subject to sanction in the event a user posted copyrighted material in (say) Community Showcase, or even by posting a video as an illustrative example in other Board categories.

That is exactly my concern. I own the copyright of the media that I post here: I think that it's highly likely that not all other users can say the same about their media. We have seen that user groups and PMs have been removed from the forums because Editshare quite reasonably wished to play safe after the EU's privacy legislation went through. It would be equally reasonable for them to decide to block uploading of media here after article 13.

Wouldn't you if you were in their position?

If I would be in their position, I would consult a layer. But not now. The European parliament has to agree to the final version of this recommendation. Afterwards it will be transferred into national law, which can take a while (years maybe) and then, I would consult the lawyer.

And by the way, as it appears the UK leaves the EU, sooner or later. What impact should European law have to a UK based website?

I think the point is that the legislation is not beneficial, and that the goal is to make the deciding body aware of reservations about it. Hence the petition linked to, above, in the first post.
